• create user accounts by automated means or under false or fraudulent pretenses;
• advertise pyramid schemes, chain letters or disruptive commercial messages or advertisements, or anything else prohibited by law, these Terms of Service or any applicable policies or guidelines;
• restrict or inhibit any other user from using and enjoying Tap Slots services;

Player Interactions and Chat

Some of our Games include social features — such as in-game chat, player profiles (name, status, location), and leaderboards — where content you enter is visible to other players. You are solely responsible for what you write. When using these features you must not: harass, threaten, bully, or abuse other players; use hate speech or sexually explicit language; impersonate any person; attempt to scam, defraud, or solicit other players; share your own or any other person’s personal information (such as real names, addresses, phone numbers, email addresses, or payment details); or send spam or advertising. We may — but are not obligated to — filter, redact, hide, mute, or remove content and restrict any player’s use of social features, at our sole discretion and without notice. Chat messages may be retained for a limited period for moderation purposes and may be reviewed when reported by other players. You can report a player from their profile in-game. Violations of this section may result in content removal, muting, or suspension or termination of your account as described in Section 1.

Auto-Generated Players

Some of our Games include social or multiplayer features that let you play alongside, with, or against other players — for example shared or private rooms, matched sessions, tournaments, and leaderboards. So that you always have participants available at an appropriate level, some of the teammates, opponents, or other players shown to you may be computer-controlled entities that appear as, and are intended to play like, real players.

International users agree to comply with their own local rules regarding online conduct and acceptable content, including laws regulating the export of data to the United States or your country of residence.

TAPSLOTS MAKES NO WARRANTY THAT (I) TAPSLOTS SERVICES WILL MEET YOUR REQUIREMENTS, (II) TAPSLOTS SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF TAPSLOTS SERVICES WILL BE ACCURATE OR RELIABLE, AND (IV) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

11. Dispute Resolution; Binding Arbitration

Scope of Arbitration Provision. Except for small claims disputes in which you or Tap Slots seeks to bring an individual action in small claims court located in the county of your billing address or disputes in which you or Tap Slots seek injunction or other equitable relief for the alleged infringement or misappropriation of intellectual property, you and Tap Slots waive your rights to a jury trial and to have any other dispute arising out of or relating to these Terms of Service or your access to or use of any Tap Slots services (including without limitation any dispute concerning the breach, enforcement, construction, validity, interpretation, enforceability, or arbitrability of these Terms of Service) (collectively, “Disputes”) resolved in court. Location of Arbitration and Applicable Rules. You and Tap Slots agree that such arbitration shall occur in Clark County, Nevada unless you are a consumer, in which case you may elect to hold the arbitration in your county of residence. For purposes of this Section 11, a “consumer” means a person using the Tap Slots services for personal, family or household purposes. You and Tap Slots agree that Disputes will be held in accordance with the JAMS Streamlined Arbitration Rules and Procedures (“JAMS Rules”). Alternatively, you may request to appear in such proceedings telephonically. You and Tap Slots agree that such arbitration shall be conducted by a single arbitrator in accordance with the rules of the JAMS Rules, as modified by these Terms of Service.

Authority of Arbitrator. You and Tap Slots agree that these Terms of Service affect interstate commerce and that the enforceability of this Section 11 will be substantively and procedurally governed by the Federal Arbitration Act, 9 U.S.C. § 1, et seq. (the “FAA”), to the maximum extent permitted by applicable law. As limited by the FAA, these Terms of Service and the JAMS Rules, the arbitrator will have exclusive authority to make all procedural and substantive decisions regarding any Dispute and to grant any remedy that would otherwise be available in court, including the power to determine the question of arbitrability. The arbitrator may conduct only an individual arbitration and may not consolidate more than one individual’s claims, preside over any type of class or representative proceeding or preside over any proceeding involving more than one individual.

Confidentiality. Allocation of Arbitration Fees. If you assert a Dispute as a consumer, you will only be required to pay arbitration fees of $250 of the fees charged by JAMS in connection with any arbitration under this section, and Tap Slots will bear all other costs charged by JAMS or the arbitrator, including any remaining JAMS Case Management Fee and all professional fees for the arbitrator’s services. You will still be responsible for paying your own attorneys’ fees.

STATUTE OF LIMITATIONS. ANY DISPUTE MUST BE FILED WITHIN ONE YEAR AFTER THE RELEVANT CLAIM AROSE; OTHERWISE, THE DISPUTE IS PERMANENTLY BARRED, WHICH MEANS THAT YOU AND Tap Slots WILL NOT HAVE THE RIGHT TO ASSERT THE CLAIM.

WAIVER OF CLASS RELIEF. WHETHER THE DISPUTE IS HEARD IN ARBITRATION OR IN COURT, YOU AGREE THAT YOU AND Tap Slots WILL NOT COMMENCE AGAINST THE OTHER A CLASS ACTION, CLASS ARBITRATION OR OTHER REPRESENTATIVE ACTION OR PROCEEDING. YOU AND Tap Slots ARE EACH WAIVING RESPECTIVE RIGHTS TO A TRIAL BY JURY OR TO PARTICIPATE IN ANY PAST, PENDING, OR FUTURE CLASS ACTION OR ANY OTHER CONSOLIDATED OR REPRESENTATIVE PROCEEDING.

Procedure to Opt Out of Arbitration Provision. You may opt out of the binding arbitration provision by sending written notice via U.S. Mail, or by any nationally recognized delivery service (e.g., UPS, Federal Express, etc.) to Tap Slots, Attn: Legal Department, 7745 Spanish Lake Dr, Las Vegas, NV 89113. For your opt out to be effective, you must send such notice within thirty (30) days of your acceptance of these Terms of Service. You must sign and date the notice, and include in it your name, address, and a clear statement that you do not wish to resolve disputes with Tap Slots through arbitration. By opting out of binding arbitration, you are agreeing to resolve Disputes in accordance with Section 12.

If any portion of this Section 11 is determined by a court to be unenforceable or invalid for any reason, (a) the unenforceable or invalid provision shall be severed from these Terms of Service; (b) severance of the unenforceable or unlawful provision shall have no impact whatsoever on the remainder of this Section 11 or the parties’ ability to compel arbitration of any remaining claims on an individual basis pursuant to this Section 11; and (c) to the extent that any claims must therefore proceed on a class, collective, consolidated, or representative basis, such claims must be litigated in a civil court of competent jurisdiction and not in arbitration, and the parties agree that litigation of those claims shall be stayed pending the outcome of any individual claims in arbitration. Further, if any part of this Section 11 is found to prohibit an individual claim seeking public injunctive relief, that provision will have no effect to the extent such relief is allowed to be sought out of arbitration, and the remainder of this Section 11 will be enforceable.

12. Applicable Law, Jurisdiction, and Venue

These Terms of Service and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the State of Nevada except to the extent preempted by U.S. federal law, without regard to conflict or choice of law rules or principles (whether of Nevada or any other jurisdiction) that would cause the application of the laws of any other jurisdiction.

Any dispute between you and Tap Slots arising from these Terms of Service or your use of Tap Slots services that is not subject to arbitration and cannot be heard in small claims court will be resolved in the state or federal courts of Nevada and the United States, respectively, sitting in Clark County, Nevada. You and Tap Slots irrevocably consent to the jurisdiction of such venues and waive any objection as to inconvenient forum.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL TAP SLOTS, ITS AFFILIATES, OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR VIRTUAL CURRENCY OR VIRTUAL ITEMS, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF TAP SLOTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 14. Virtual Currency, Virtual Items, Purchases, and Refunds

The Games are free to play and no purchase is necessary. Coins, credits, gems, rewards, and other virtual currency or virtual items (“Virtual Items”) are licensed to you as a limited, personal, revocable, non-sublicensable, and non-transferable right to use within the Games. Virtual Items are not your property, have no monetary or “real-world” value, and cannot be redeemed for, sold, transferred, or exchanged for real money or anything of value outside the Games. Purchasing Virtual Items does not improve your chances of winning real money or prizes (there are none); Virtual Items only extend entertainment play.

We may manage, regulate, control, modify, suspend, or eliminate Virtual Items at any time, with or without notice, and we will have no liability to you or any third party for doing so. Where permitted by applicable law and the relevant app-store rules, unused Virtual Items may expire.

Purchases are processed by the applicable app store (Apple, Google, or Amazon) and are subject to that store’s terms; we do not receive your full payment-card details. All purchases are final and non-refundable except as required by applicable law or the rules of the applicable app store. We may be unable to issue direct refunds for app-store purchases; refund requests are generally handled by the app store. Fraudulent chargebacks or abuse of the refund process may result in suspension or termination of your account and forfeiture of Virtual Items.

15. Anti-Cheat and Account Integrity

To protect the integrity of the Games and other players, you agree that you will not: cheat, exploit bugs or errors, or otherwise manipulate or interfere with game outcomes, randomization, scoring, or balances; reverse engineer, decompile, or disassemble the Services except to the extent permitted by applicable law; use bots, scripts, automation, modified clients, or unauthorized third-party software or tools; access or use another person’s account; sell, buy, trade, or transfer your account or any Virtual Items; abuse refunds or chargebacks; or circumvent any security, authentication, age, or territorial restriction. If we have a public profile, name, leaderboard, or other user-generated content feature, we may filter, refuse, move, or remove content and provide reporting and blocking tools. Violations of this Section may result in suspension or termination of your account and forfeiture of Virtual Items and progress.

16. App Stores and Platform Terms

The Games are distributed through third-party app stores, including the Apple App Store, Google Play, and the Amazon Appstore, each of which has its own terms that also apply to your use of the Games. These app stores are not parties to these Terms and are not responsible for the Games or for any support, maintenance, warranties, or claims relating to them. To the extent the Apple App Store’s standard Licensed Application End User License Agreement applies to your use of an iOS app, that agreement also governs, and Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you. In the event of a conflict between these Terms and an app store’s terms, the app store’s terms control for matters within their scope.

17. Effect of Termination

We may suspend or terminate your access to the Services at any time as described in Section 1. On suspension or termination, you may lose access to your account, game progress, Virtual Items, and any content associated with your account, and Tap Slots will have no liability to you and owes no refund or compensation, except as required by applicable law. Provisions that by their nature should survive termination — including Proprietary Rights, Disclaimer of Warranties, Limitation of Liability, Indemnity, Dispute Resolution; Binding Arbitration, Applicable Law, and this section — will survive.

18. General Information

19. Photosensitive Seizure Warning

These seizures may have a variety of symptoms, including lightheadedness, altered vision, eye or face twitching, jerking or shaking of arms or legs, disorientation, confusion, or momentary loss of awareness. Seizures may also cause loss of consciousness or convulsions that can lead to injury from falling down or striking nearby objects.

Immediately stop playing and consult a doctor if you experience any of these symptoms. Parents should watch for or ask their children about these symptoms — children and teenagers are more likely than adults to experience these seizures. The risk of photosensitive epileptic seizures may be reduced by playing in a well-lit room, not playing when you are drowsy or fatigued, and taking regular breaks. If you or any of your relatives have a history of seizures or epilepsy, consult a doctor before playing.
